How can I make a name change affidavit?
Step 1: Affidavit
1. Contact your local notary and explain your situation.
2. The notary will recommend a stamp paper with the requisite value for the affidavit of name change.
3. Once you've received the paper, you must supply the following information: Your name and your new name, Your current location
Introduction to the new name (Astrology, numerology, marriage, etc)
4. Two witnesses must sign the affidavit once it has been printed on plain stamp paper. It must be signed by two persons of gazetted officer rank according to the legal process. Make sure you have their signature as well as their stamp (rubber stamp).
5. In the event of a central government employee, the procedure for a name change must be done in accordance with the Ministry of Home Affairs O.M. No. – 190016/1/87-Estt. The date is March 12, 1987. Consult the Notary or read the guidelines.
6. Married women who want to change their last name or add their husband's initials must supply the following information:
A previous name with the father's name and address;
A new name with the husband's name and address;
The date of the marriage.
Your previous and new names are reflected in the affidavit. Affidavits can be used to change a person's full name, surname, or just a few letters in their name.
A copy of the affidavit should be kept. This is an important document that will come in useful for any future legal requirements.
For NRIs who want to alter their names, they must file a document stating the name change, which must be signed by the Indian High Commission or the Indian Embassy.
Step 2. Newspaper Publication
If you've completed the affidavit, the next step is to place an ad/notification in the local newspaper announcing your new name. You'll need two newspapers for this: one published in the state's official language and the other an English daily.
If you live in Madhya Pradesh, for example, you can choose between Dainik Bhaskar and Times of India/Hindustan Times. Dinakaran/Dina Thanthi and The Hindu/Indian Express are two options for Tamil Nadu residents. The criterion is to choose two popular daily publications and send them a request with the following information:
Your current name;
Your previous name
Your birthdate
Your address
Advertisement for a Name Change
Newspapers dedicate a column to these notices and will be able to assist you with this. Any newspaper can provide the format. Here's an easy example. Let's say XYZ decides to change his name to ABC.
I, XYZ, residing at, have changed my name to ABC and will be known as ABC from here on in. I have submitted an affidavit to this effect, which was signed by on.
Married ladies should include their husband's name and address in the notification if they want to alter their surname after marriage.
When your notice appears in the newspaper, remember to grab as many copies as you can and keep them for future reference. Although one copy will serve, it is preferable to keep as many original newspaper ad copies as possible just in case.
Step 3. Gazette Notification
Your legal name change will be finalised after your gazette notification is published. For those employed by the government, the name change gazette notification is required; for others, it is optional. It is, nevertheless, considerable evidence of your name change. It may make sense to go ahead with it because it just entails sending a few documents for publishing.
To submit the Gazette notification, follow these steps:
Carry a copy of the ‘Deed changing name form,' which can be obtained from the Department of Publication's Controller of Publication. Alternatively, a letter from you stating the need for the name change will suffice.
Original copies of advertising with the date should be carried. (Attach both advertisements.)
Carry two verified images to guarantee that the transaction goes smoothly;
Carry proof of address and identification. (The address must match the one reported in the newspaper and affidavit.) Any change of address may result in the application being rejected).
Before sending in the following information, call the Controller's Office of Publication to acquire a complete list of what needs to be supplied, and make a note of it. Also, before mailing the documents to the agency, place them in an A4-sized envelope.
The Controller of Publications office will deliver information along with copies of the Gazette in which the advertisement/notification was published. Keep this in a safe place for future use.
